Montpelier, Vermont- Vermont Attorney General Bill Sorrell has filed an appeal in the case against Vermont Yankee.
In January a federal judge ruled in favor of Entergy Nuclear, the company which owns the Vernon based nuclear power plant. The Ruling stated the plant should be allowed to operate past March 21, 2012, the date its state license expires.
Sorrell filed the appeal to the Second Circuit Court of Appeals Saturday morning.
"We have strong arguments to make on appeal. The district court's decision improperly limits the state's legitimate role in deciding whether Vermont Yankee should operate in Vermont beyond March 21, 2012," said Sorrell.
The Vermont Senate had previously voted against renewing the plant's operating license.
In a Statement released shortly after the appeal was filed, U.S. Senator Bernie Sanders, I-Vt., says he supports the appeal.
"I support the decision by Vermont to appeal the flawed ruling by Judge Murtha in the Vermont Yankee litigation," said Sanders. "I believe the law is clear that states have the right to reject nuclear power based on economic and other reasons that have nothing to do with safety."
The appeal will go to the Second Circuit Court of Appeals in New York City.
